When you sign up for a VerveCards membership, VerveCards requires that you provide certain personally identifiable information, which may include:
first and last name,
telephone number, and
VerveCards does not allow children under the age of 13 on the Site, nor does VerveCards knowingly collect any information from any person under the age of 13. If VerveCards is informed that a person under the age of 13 has created a VerveCards account, VerveCards will immediately remove the account and any personally identifiable information that may have been inadvertently collected by VerveCards.
Use of Personally Identifiable Information:
VerveCards uses the personally identifiable information that it collects about you for several reasons including, but not limited to:
contacting you in response to consumer-initiated inquiries;
providing to you the services that you request;
sending the ecards and/or gift memberships that you request;
sending our opt-in newsletter;
contacting you regarding billing, customer service, legal, administrative, and any alleged violations of the Terms of Service;
providing you with requested information regarding VerveCards or the Service; and
requesting user feedback from you in order to improve the Site.
VerveCards neither shares nor sells any personally identifiable information that it collects from you to third parties. However, VerveCards we may, from time to time, contact you about offers, or offers from third parties with which we may partner, that we believe, in our sole discretion, may interest you. When we do so, we contact you directly on behalf of the third-party partner, without sharing your personal information. If you would prefer not to receive such marketing information from VerveCards, you may unsubscribe at the bottom of each marketing communication.
VerveCards does not use the email addresses of your gift membership or ecard recipients for any marketing purposes. Those email addresses are only used to deliver the gift memberships or ecards that you have requested that we send on your behalf.
VerveCards is not an anonymous mail service. Your IP address and email address attach to each ecard that you send and may be used by the recipient, or by other parties, to identify you as the sender of the ecard. A recipient of a VerveCards ecard can elect not to receive future communications from VerveCards by following the instructions found at the bottom of each ecard.
VerveCards reserves the right to release current or past user information: (a) in the event that we believe that the Site is being or has been used in violation of the VerveCards.com Terms of Service, or to commit unlawful acts; (b) upon receipt of a properly authorized and authenticated governmental request for information; (c) in response to a subpoena or a court order, (d) to comply with relevant laws; (e) in response to an investigation of fraud regarding a specific consumer; (f) in an effort to safeguard the person or property of a VerveCards employee or a third party; or (g) if VerveCards is bought, sold or acquires another company.
Moreover, you hereby consent to disclosure of any record or communication to any third party when VerveCards, in its sole discretion, determines the disclosure to be appropriate, including, without limitation, sharing your email address with other third parties for suppression purposes in compliance with the CAN-SPAM Act of 2003, as amended from time to time.
Your use of the Site or the Service does not authorize you in any way to add other users of the Site or the Service to any mailing list without their express consent. Posting of a user's email or postal address to public areas of the Site is not considered to be "express consent." If it is brought to VerveCards' attention that you are sending spam or other unsolicited material to our users, we will immediately terminate your account and will cooperate with all legal authorities to aid in your prosecution for violations of state and federal spam laws.
Storage of Information:
All payment information is transmitted via Secure Socket Layer (SSL) technology from the Site to our third-party payment processor, Authorize.net, where all such information is stored in a secure environment. Payment information is not retained by VerveCards directly.
All other personally identifiable information is stored on VerveCards' servers in a secure operating environment. Although VerveCards does not release your personally identifiable information to third parties, and we make a reasonable good faith effort to store your personally identifiable information in a secure operating environment, no system or internet transmission is 100% secure due to the interconnected nature of the internet and other factors beyond our control.
Please also be aware that even encrypted emails can be intercepted by unsavory individuals who are interested in gaining your personal information. No amount of Site security will ever make transmission over the internet 100% secure. Understanding the limitations of privacy over the internet is very important. Make sure that you protect yourself and your personal information at all times.
Accessing Your Personally Identifiable Information:
VerveCards members have the ability to review, correct, and update personally identifiable information collected by VerveCards, including name, address, email address, telephone number, payment information, login, and password, by clicking the "My VerveCards" link in the upper left corner of every Site page, then "Membership Info" at the bottom of the next menu that appears.
If you wish to review, correct, or update other personally identifiable information not referenced above that VerveCards has collected from you, you may send a request in writing to VerveCards, P.O. In order to prevent identity theft, VerveCards may take reasonable steps to confirm your identity prior to supplying any personally identifiable information to you.
